WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) has reached the congressionally mandated H-1B cap for fiscal year (FY) 2016. USCIS has also received more than the limit of 20,000 H-1B petitions filed under the U.S. advanced degree exemption.USCIS will use a computer-generated process, also known as the lottery, to randomly select the petitions needed to meet the caps of 65,000 visas for the general category and 20,000 for the advanced degree exemption.
USCIS would like to inform stakeholders about the proper action to take if cap-subject filings for fiscal year 2016 H-1B petitions are mishandled by delivery services. If a petitioner filed an FY16 H-1B cap petition in a timely manner, but received notification from the delivery service that suggests that there may be a delay or damage to the package, the petitioner may file a second H-1B petition with a new fee payment and the following:
USCIS has received enough petitions to reach the congressionally mandated H-2B cap for fiscal year (FY) 2015. March 26, 2015 was the final receipt date for new H-2B worker petitions requesting an employment start date before October 1, 2015.

Grants Will Support Citizenship Preparation Services for Permanent Residents
The Form I-90, Application to Replace Permanent Resident Card is now available in the USCIS Electronic Immigration System (USCIS ELIS). USCIS ELIS is an online, account-based system that allows you to submit and view certain immigration benefit requests and receive electronic notification of decisions and real-time case status updates.
On October 9, 2014 USCIS hosted an engagement with AILA representatives. During this meeting, USCIS addressed questions related to the status of L-1B guidance, issuance of unnecessary request for evidence (RFE), O and P petitions, and I-130 appeal delays among several other topics.

Workload Realignment
USCIS recently began transferring some Form I-130, Petition for Alien Relative, cases filed by lawful permanent residents for their eligible family members from the Vermont Service Center to the California Service Center.
